Tangata Whenua Participation

The RMA provides directly and indirectly for tangata whenua participation in the preparation of policy statement and plans and decisions on resource consent applications. The RMA also enables the transfer of resource management powers to iwi authorities and joint management agreements.

Exercise of kaitiakitanga

There is provision in the RMA for local authorities to transfer their functions, powers or duties under the Act to public bodies including iwi authorities (section 33). To date, local authorities have generally been reluctant to relinquish their powers in this manner. More recently, in the 2005 amendments to the Act, provision has been made for the development of joint management agreements. Such agreements may be made between a range of parties including local authorities, other public authorities, iwi authorities and groups that represent hapu (sections 36B-E).
