If you are unhappy about a decision of a council or requiring authority on a proposed policy statement or plan, you may decide to lodge an appeal (previously referred to as a reference) with the Environment Court. Commencing proceedings in the Environment Court carries a risk that you may have costs awarded against you if unsuccessful. You may therefore wish to seek the advice of a lawyer as to the merits of the appeal before proceeding.
Form of an appeal
Appeals must be prepared in accordance with Form 7 of the Resource Management (Forms, Fees, and Procedure) Regulations 2003.
